Disappointing not to prosecute but, seeing how the observers were onboard to observe and film, footage was taken, the decision  to charge or not was not made at the time of the offence.  Bit like the police knowingly know who an offender is and not taking action hoping it will lead to bigger offences?
Now were these vessels nz owned/flagged crewed or vessels on contract to a nz fishing Co?
Knowing what some of these crew persons are like wouldnt be hard to say,Oh he/she had an accident and slipped?

You would have to be thick to dump fish in front of an observer unless they knew nothing would come of it... makes you think an overhaul of MPI isn't enough, feels like MPI is taking the piss

Ok so the Observers on board were monitoring dolphin mortality, not fish dumping. Hence the decision not to prosecute under the Fisheries Act. Similar to the Uruwera trials where evidence gathered under the Anti-Terrorism Act was deemed inadmissible for charges brought under the Firearms Act.

They themselves said they didn't prosecute because the boats volunteered to be monitored for dolphin by-catch and a prosecution would make it very hard to continue ongoing monitoring - which is a fair call

But my point still stands.... why on earth would you continue to dump fish at those volumes on video surveillance & in front of an investigator unless you felt there was some kind of immunity implied?

"We couldn't prosecute because of the legislation - we couldn't use the evidence gathered by the video footage,"

What a load of BS - every spoonful of crap they feed us is only lubricating that noose knot.

With MPI's track record you would have to be slow to not understand the skepticism?
